What Irish employers need to give new staff in writing

Since the EU (Transparent and Predictable Working Conditions) Regulations 2022 (S.I. No. 686 of 2022), which amended the Terms of Employment (Information) Act 1994:

  • Within 5 days of starting: a written statement of the core terms, including the names of employer and employee, the employer’s address, place of work, job title or description, start date, expected duration (if temporary or fixed-term), pay and pay reference period, normal working hours, and the duration and conditions of any probation period.
  • Within 1 month of starting: the remaining written terms, such as annual leave, notice, sick pay, pension, training and any collective agreements.
  • Probation: generally no more than 6 months. It can be longer only in exceptional cases, where that is in the employee’s interest, and to a maximum of 12 months.
  • Failing to provide these statements can lead to a complaint to the Workplace Relations Commission.

If your contracts were written before December 2022, they may need updating.

The ainm platform

Prefer to do it in-house?

The ainm HR platform has contract templates for Irish employers. It fills in a contract for each new hire, keeps probation within the legal limits, exports to Word, and sends the contract for e-signature, with you countersigning as the employer. It can also check an existing contract for gaps.

It’s included in the Growth plan, together with the handbook and policy builders.
